Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Hexaquark LLC ("Hexaquark", "we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

Hexaquark provides real-time infrastructure software, APIs, and related services ("Services") for building modern web applications. Our Services include high-performance messaging systems, real-time data streaming, and developer tools. We reserve the right to modify, suspend, or discontinue the Services at any time without prior notice.

2. Account Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit malicious code or interfere with the Services
• Attempt to gain unauthorized access to our systems
• Use the Services for any illegal or unauthorized purpose
• Resell or redistribute the Services without authorization

4. Payment Terms

If you purchase paid Services:

• All fees are quoted in US Dollars (USD) unless otherwise specified
• Payment is processed securely through Stripe, a PCI Level 1 certified payment processor
• We accept Visa, Mastercard, and American Express
• You authorize us to charge your payment method for all fees incurred
• All fees are non-refundable except as expressly stated in our Refund Policy

Your payment information is transmitted securely using HTTPS/TLS encryption. We do not store your credit card details on our servers—all payment data is handled directly by Stripe in compliance with PCI DSS standards.

5. Refund Policy

Refund requests are evaluated on a case-by-case basis. To request a refund:

• Contact us within 14 days of your purchase
• Provide your order details and reason for the refund request
• Refunds, if approved, will be processed to your original payment method within 5-10 business days

We reserve the right to deny refund requests that do not meet our criteria or appear to be abusive.

6. Subscription Cancellation

For subscription-based Services:

• You may cancel your subscription at any time through your account settings or by contacting us
• Cancellation takes effect at the end of the current billing period
• No prorated refunds are provided for partial billing periods
• You retain access to the Services until the end of your paid period

7. Intellectual Property

All content, features, and functionality of the Services are owned by Hexaquark and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. User Content

You retain ownership of any content you submit through the Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing the Services.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEXAQUARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

12. Indemnification

You agree to indemnify and hold harmless Hexaquark and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.

16. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services will cease immediately.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
